2. Collection of Personal Information
2.1 The types of Personal Information we collect and how we collect it depends on the circumstances. If you apply to be, or are, a User, we collect Personal Information about you:
(a) if you wish to subscribe to our newsletter or blog;
(b) to process your details provided during registration of a User Account;
(c) to provide Services to you;
(d) to identify you as a User for security purposes and to comply with our legal obligations;
(e) to maintain and manage your Account;
(f) to upgrade and enhance your experience when using the Covered Platforms;
(g) to tailor or develop information, Services or products which we think may suit your needs; and
(h) for marketing related purposes, including conducting research, conducting promotions, sending you newsletters and telling you (including via email, SMS or telephone) about Services or products we think may be of interest to you).
2.2 We typically collect the following kinds of Personal Information:

2.3 We will ordinarily collect your Personal Information directly from you, primarily through your use of the Covered Platforms or over the telephone. We may also collect Personal Information indirectly, for example through agents or affiliates we engage to undertake marketing activities. We may also be required by law to collect some Personal Information about Users who use the Covered Platform and/or Services.
2.4 Fantain’s web servers automatically collect limited information about User’s computer’s connection to the Internet, including User’s IP address, when the User visits the Covered Platform. A User’s IP address does not identify the User personally. Fantain uses this information to deliver its web pages to Users upon request, to tailor its Covered Platforms to the interests of its users, to measure traffic within the Covered Platform and let advertisers know the geographic locations from where the Covered Platform’s visitors come.
2.5 We may also collect Personal Information from job applicants, our employees and individuals associated with our business partners and service providers. Usually this information is limited to name and contact details and the other information we need for the purpose of managing the employment or business relationship.
3. Notification and Collection of Personal Information
3.1 When we collect Personal Information about you, we take reasonable steps to ensure that you are aware of certain information relating to our collection, use, disclosure and handling of Personal Information. This is usually done through a 'collection statement' or similar document at the time of collection of the Personal Information.
3.2 When you become a User, and in other situations where you provide Personal Information to us, we may deem your provision of Personal Information to be consent to Fantain collecting, using and disclosing your Personal Information in accordance with the relevant collection statement.
4. Us and Disclosure of Personal Information
4.1 Fantain only uses and discloses Personal Information for purposes that are related to the purposes for which we have collected the information. For Users and applicants for registration on the Covered Platform, this means we mainly use Personal Information for purposes connected with establishing and administering the registration and providing Services and products through the Covered Platform.
4.2 We may use Personal Information to generate, either ourselves or through our affiliates and third-parties, aggregate data about our Users through demographic profiling and statistical analysis of its database, in order to allow for more efficient operation of our business.
4.3 Fantain may disclose your Personal Information:
(a) to our agents and affiliates who undertake promotional and marketing activities on our behalf (including contacting you with special offers that may be of interest);
(b) to organisations that provide services (including IT, consultancy and advisory services) to us;
(c) to any particular third parties or classes of third parties that Fantain notifies you at the time of collecting your Personal Information that your Personal Information may be disclosed to;
(d) for taking appropriate action if we have reason to suspect any Malpractices;
(e) to protect and maintain the integrity of particular sports, by assisting controlling bodies in their inquiries or notifying such bodies of any activity Fantain considers to be unusual or suspicious;
(f) where you have consented to the disclosure either expressly or by the circumstances and your conduct;
(g) where we consider disclosure is reasonably necessary to eliminate or minimise a risk to public health or safety,
(h) where we consider disclosure is reasonably necessary to investigate or deal with unlawful activity or serious misconduct;
(i) where we consider disclosure is reasonably necessary to locate missing persons;
(j) to establish or defend a legal claim;
(k) where the disclosure is required or authorised by law.
4.5 Fantain does not disclose Personal Information to persons outside India.
5. Direct marketing and opting out
5.1 When registering as a User, you may choose to receive promotional or marketing information from us when you select the appropriate option on the registration page. If you opt to receive promotional or marketing material from us, we may, from time to time, use your Personal Information to inform you about our Services or products or about promotional activities, which we believe, may be of interest or of benefit to you. We may do this via email, SMS, telephone or mail.
5.2 If you no longer wish to receive marketing or promotional material from us at all or in any particular form, you may contact us at any time by email to email@example.com with your request with which we will comply as soon as is practical. Where we send you promotional materials, such messages typically will contain a functional means for you to opt-out of receiving such messages.
5.3 From time to time we may contact you in relation to the management and administration of your User Account. These communications can be via any of the modes of contact recorded when registering as a User. Such communication is not affected by your opt-in or opt-out status for direct marketing communications.
6. Personal Information and the Covered Platforms
6.3 You acknowledge that no data transmission over the Internet is totally secure. Accordingly, Fantain does not warrant the security of any information, which you transmit to it. Any information that you transmit to Fantain is transmitted at your own risk. You further acknowledge that all User Generated Content becomes public information. Fantain does not guarantee the security of this type of information.
6.5 We may use third parties to serve ads on the Covered Platform. The advertisers may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.
7. Management and security of Personal Information
7.1 Fantain will take all reasonable steps to ensure that the Personal Information, which it collects, uses or discloses, is correct and is stored in a secure environment that is accessed only by authorised persons.
7.3 Fantain’s employees, agents and contractors are required to maintain the confidentiality of User’s Personal Information.
7.4 Fantain takes reasonable measures to ensure that Personal Information which it collects is accurate, complete and current and also when it uses and discloses it, that it is relevant, having regard to the purpose for which it is being used or disclosed. We give you the opportunity to correct and update Personal Information at any time, and may contact you on a periodic basis to seek the most up-to-date information from you. We will correct your Personal Information if we are satisfied that it is accurate and needs to be corrected.
8. Personal information about children
8.2 You are responsible for the security of and access to the Covered Platform. You must log out of your Account when you have completed your time on the Covered Platform, and should not disclose your username, password or any Account information to any other person.
9. Access to and correction of Personal Information
9.1 You may access Personal Information about you held by Fantain by following the “My Account” link on the Covered Platform or by contacting us at firstname.lastname@example.org. To do so, you will need to provide evidence to confirm your identity before we can provide access. We will generally respond to all requests for access within 30 (thirty) days of the request. If your request is particularly complex, or requires detailed searching of our records, there may be a cost to you in order for us to provide the information.
9.2 Details of your transactions, deposits and withdrawals can also be accessed via the “Passbook” tab of the “Account Balance” section.
9.4 If we refuse your request or cannot give you access in the manner you have requested, we will do what we can to meet your requirements by other means. If we refuse access to your Personal Information, we will advise you in writing of the refusal, the reasons for the refusal, and the complaint mechanisms available to you.
9.5 If you believe that the Personal Information Fantain holds about you is inaccurate, incomplete or not current, please let us know and we will investigate and correct any inaccuracies if we are satisfied that a correction is required. Your Personal Information can be updated or corrected by you in the “Account Details” section of the Covered Platform at any time after you log in. 10. Conditions of use
FANTAIN DOES NOT WARRANT THAT THE COVERED PLATFORMS, THEIR SERVERS, OR EMAIL SENT BY US OR ON OUR BEHALF ARE VIRUS FREE. WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE COVERED PLATFORM, INCLUDING, BUT NOT LIMITED TO COMPENSATORY, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL AND CONSEQUENTIAL DAMAGES, LOSS OF DATA, GOODWILL, BUSINESS OPPORTUNITY, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. IN NO EVENT WILL FANTAIN LIABILITY EXCEED RS. 100.
11. Complaints and further information
11.1 If you believe your privacy has been interfered with and wish to make a complaint, please contact our compliance and legal team. Our team will investigate your complaint and notify you of the outcome. If your complaint indicates that there has been an interference with your privacy by a person other than Fantain, the compliance and legal team may discuss your complaint with that other person in an attempt to resolve it.
